Phone calls could violate court order

An Eden Valley woman’s phone calls to an ex-husband could land her in jail. Rochelle Lynn Smith, age 36, pled not guilty on Jan. 27 to a charge of violating an order for protection.

According to documents filed in district court, on Jan. 23 at approximately 2 p.m. a Montgomery police officer was dispatched to the 300 block of SE Elm Ave. to take a report of an order for protection violation. The responding officer met with a man who had obtained an order for protection against Smith on Jan. 14. Smith allegedly contacted the man by telephone on Jan. 17, Jan. 20 and twice on Jan. 23. The calls were recorded on an answering machine and are a violation of the court order.

Smith was taken into custody by Stearns County authorities. She faces as much as 90 days in jail and/or a $1,000 fine. A pre-trial hearing will take place on Feb. 17.

• Joshua Scott Piha, age 25 of Waterville faces felony charges after his third domestic assault charge within the past year.

According to a complaint filed at the Le Sueur County courthouse, on Jan. 16 at approximately 5:16 a.m. the Waterville Police Department was dispatched to a report of an assault. A deputy met with the victim who stated her live-in boyfriend, Piha, had assaulted her.

In a taped statement to police, the victim said she was awoke by Piha at about 2 a.m. The woman said Piha sounded drunk and she attempted to leave the residence. Piha prevented her from leaving and locked the door. When she attempted to call 911, Piha disconnected the phone. She was able to leave the house, but Piha pursued her and repeatedly pushed her down. She went back into the house to get her keys and Piha locked her in the house. She finally escaped and fled on foot to her father’s house which was nearby.

Officers found Piha hiding under the basement stairs of his residence. He was arrested and taken to the Le Sueur County Law Enforcement Center. Piha has two previous domestic assault convictions dating from April and May of 2009. Because of this, Piha is being charged with felony-level domestic assault which carries a maximum penalty of five years in jail and/or a $10,000 fine. He is also being charged with false imprisonment, which is punishable by as much as three years in jail and/or a $5,000 fine; and interference with an emergency call which carries a maximum penalty of one year in jail and/or a $3,000 fine.

On Jan. 27 Piha was released on $250 bail under the condition he have no contact with the victim. An omnibus hearing has been scheduled for Feb. 9.

• On Jan. 16 at approximately 12:48 a.m. a Le Sueur County sheriff’s deputy on patrol on County Road 21 observed a vehicle with the right headlight burned out. According to the deputy’s report, he initiated a traffic stop and identified the driver as Laura Renee Hubmer, age 22 of Mankato. While speaking with Hubmer, the deputy detected an odor of alcohol on Hubmer’s breath.

After failing field sobriety tests, Hubmer submitted to a preliminary breath test which showed a blood alcohol content of .15. She was transported to the Le Sueur County Law Enforcement Center.

On Jan. 27 Hubmer pled guilty to fourth degree driving while impaired, was fined $430 and placed on one year probation. She was also required to complete a chemical dependency evaluation and attend a MADD panel.
